This issue is regulated by the Federal Law "On Protection of Consumer Rights". The way to solve it depends on the grounds on which the buyer intends to return the thing to the seller:
- quality does not match, defects are present;
- the product is high-quality, but does not suit by any criteria (dimensions, color, design).
Note: when choosing a sofa, consider the width of the doorways so that the purchased furniture can pass through the door.
The buyer has the right to return in the presence of defects identified upon receipt or during the warranty period, the minimum period of which in accordance with Art. 5 Law on the Protection of Consumer Rights is 12 months and can be increased to three years at the request of the manufacturer.
Legal acts governing the return of purchase of good quality
In the case of high-quality goods, a return can be made based on Art. 25 of the specified law. According to this provision, within two weeks after the acquisition, the consumer has the right to exchange the product for a similar the product without explanation, if it was not in use, has a presentation, and a document confirming payment has been saved.
If the desired product is not available for sale on the same day, the customer has the right to return the purchased furniture and receive a three-day period, the money paid for it, or, by agreement of the parties, wait until the desired product appears in stock.
If the sofa was purchased remotely, for example, in an online store, then you can return it within 7 days from the date of delivery (Art. 26.1) and within 10 days to receive the money spent minus transportation costs. True, not everything is so simple, because there is a list of exceptions to these rules.
In which cases the buyer can not return the sofa
The exceptions are:
- Sofas purchased as part of a furniture set or a headset, as they relate to complex technical products and are not refundable. If it was acquired as a separate unit, then it is returned according to existing rules.
- Products made to order, as they were manufactured according to individual parameters under a service agreement and under the action of Art. 25 miss.
Please note: when purchasing furniture made of genuine leather, it should be borne in mind that for such materials there may be a slight deviation from the sample in texture and color shade is allowed, which is not the basis for return.
What to do if the model is not liked, but it has already been purchased
A thing can be returned if the conditions are met:
- it is a single item not included in the set;
- acquisition time did not exceed 14 days;
- there is a check of payment;
- the presentation and properties are not violated.
If you have these conditions, you can contact the store and write an application for the exchange of the sofa or a refund.
